Chambers Guide to the Legal Profession

Resolution without litigation

I first heard about mediation from a lawyer. We’d been discussing some of the shortcomings of litigation. It was too stressful, we agreed. Too time-consuming, too expensive. And we were amazed how often the result suited neither party.

In fact, he said, he’d become a mediator when he realised how much better the mediation process served his clients’ interests.

I quickly realised that I wanted to do the same, and for 20-odd years now I’ve provided a civilised and confidential environment in which I help people to stop arguing with one another and simply negotiate.

It takes patience and persistence as well as experience – not to mention an instinctive understanding of people in general. But in over 80% of cases I’ve been able to find what people actually want, not just who’s right and who’s wrong and who’s entitled to what.

I’ve helped them to go home at the end of the day (it usually does take just a day) with the dispute firmly in the past and their minds on the future.
